THE PATHETIC CASE OF JUSTICE HIDAYATTULLAH
Bangalore: The 87-year-old former Muslim Vice-President and ex-Chief Justice of India, M. Hidayathullah, died on Sept.18, 1992 in Bombay, A man of great stature, learning and excellent authorship on Islamic law, died and we felt for the loss of a top Muslim intellectual all though we had been regretting that such an eminent Muslim has not been property made use of by the Indian Muslims.
Before we could reconcile, ourselves with these thoughts, we had another shocking news the next day that his body was cremated in the true Aryan fashion of burning the dead involving waste of precious wind throughout India and thousands of volts of electricity in big cities in electric crematorium. That apart, the already polluted Indian atmosphere is polluted everyday by these cremations. But our ecology and environment heroes and zeros mysteriously remain silent
Ganga, dirtiest river: The Ganga River, the water of which is considered sacred, divine and physically and spiritually healing has become the dirtiest river in the world, to clean which Government is spending crores The pollution caused to it is by throwing ashes and bones of fully burnt and half burnt upper caste dead bodies. The cost of burning in full is the highest i.e. As.1,000 and “poor” dead bodies receive just a little flame for Rs. 250 and cause greater pollution. (These figures are 2-3 years old. We do not know of the current rate). Similarly, all other rivers are polluted, but the Ganga being the most “sacred receive the maximum pollution.
Useful even after death: Less than 15% of the Indians, the upper castes, during their entire life time fatten themselves by consuming the sweet and blood of shudras, Dalits (Panchama’s), Muslims (Meloche’s) and others. And even while departing from the world, they pollute Indian waters and atmosphere while 90% of the Indians, the real children of the soil, bury their dead and fertilize its soil.
They being original Indians love their land so much that even after death cling to it underneath the surface through buntal.
Aryans hate India: But the non-Indian Aryan invaders live in this land only to survive upon its food and dissolve their flesh in the atmosphere after their death by cremating themselves so that their dust particles return to the air of the country of their origin or get mixed up in the Arabian sea or the Bay of Bengal away from the land of the dirty, sweating, toiling Black Indian shudras, Untouchables, Miches (Muslims) and Christan converts.
Since the upper caste Hindus are the rulers for the time being, even some non-upper caste copy-cats have also started imitating their Aryan masters.
Hamid Dalwal example: Pune’s notorious Hamid Dalwai was the first Muslim to opt for this dirty practice of writing a will to be cremated. He was a well-known Hindu nazi stooge and sworn enemy of Muslims. The next prominent Muslim was M.C. Challa, who prostrated before every Brahmin. He was followed by another Muslim intellectual, Ismat Chughtai. And the last one is the ever silent, graceful and highly respected Justice Hidayatulla. What prompted him to resort to the this ugly, unhealthy, polluting practice is beyond our comprehension. Maybe he has not written such a will, but his Hindu wife, Pushpa, has played into the hands of Hindu nazi agents to convert a prominent Muslim to brahminism at least after his death.
An inquiry in this matter is required. But who is to do?? We are currently witnessing the brahminisation of India.
Did he die a Muslim? Musim religious scholars say that it is the end of a Muslim which stands as a proof of his faith in Islam. From this cremation episode, they will have to decide whether Hidhayathulia died as a Muslim. A posthumous fatwa (edict) of Hidayatulla death as a Muslim or otherwise is urgently required so that such Muslims may not be chosen to high offices in the Muslim quota to parade Indian Islam and secularism. And to know their real faces, Muslims will not have to wait their death.
Muslim religious leaders will have to demand from the govt, a declaration from every Muslim occupying high position regarding the disposal of his dead body-cremation in the upper caste fashion or burial in true Islamic and Indian style just as the oath of allegiance to the Constitution is taken. If he opts for cremation, he should not be considered in the Muslim quota.
Jinnah’s example: In this context, it is interesting to recall an incident from Jinnah’s life. This sub-continent has not produced a more liberal, enlightened and modem Muslim than Jinnah. With all his liberalism, as early as in 1918 when he was a staunch secularist, a prophet of Hindu-Muslim unity and an opponent of separate electorate for Muslims, he never ignored the common injunctions of Islam. When a Parsi girl, Miss Ratan Petit, fell in love with him and wanted to marry him, he had put a condition that they would not marry a non-Muslim and her conversion to Islam is a must. Only after she became a Muslim, he married her with the Islamic nikah ceremony and when she died in 1929, he Insisted and got her buried In the Islamic way in spite of stiff opposition from her Parsi family.
And again, when his daughter, Dina Jinnah, through Ratan Petit, married a Parsi under the influence of her maternal family, he boycotted her for his whole Idea. This was the same Jinnah who created Pakistan, but still bequeathed one-third of his assets to Bombay University (Hayat-e-Mohammed Al Jinnah, Rayees Ahmed Jefrey, Taj Office, Bombay 1946, pages 84 to 89)
Slavish Muslims: The tribe of liberal or un-islamic Muslims like Hidayathulla should know that imitating the customs and manners of rulers does not mean liberalism but it means slavery. They carinot live like namesake Muslims, fool the Muslims and die like upper castes.
Bombay Muslim failure: As per the Islamic Shariat, disposal of the dead body of a Muslim is farz-e-Kaya, i.e. a duly cast on the nearest Muslims. It is an obligation of society and duty of the State. And rules are prescribed for it and the rule is burial. A Muslim has no right to prescribe an un-Islamic method for himself. As soon as he dies, his last remains become the possession of the society, not of his wife or children and the society is held responsible for deviations. Being the nearest, the Muslims of Bombay should have asserted this right and duty and not allowed its cremation, whatever be the reasons – the Deadman’s will, his wife’s assertion or son’s failure. By this failure, the Muslims of Bombay have committed a sin, brought shame to all Indian Muslims, Bombay Muslims should repent and Muslim ulema should educate the masses about their rights and duties on this point. Silence of the ulema makes Islam a laughing stock.
